Terms of Service

These Terms of Service (the "Agreement" or "TOS") are entered into by and between you ("you," "your," or "Customer") and Alterascape, LLC ("Alterascape," "we," "us," or "our"), a United States limited liability company. This Agreement governs your access to and use of the Alterascape website (alterascape.com), client portal (my.alterascape.com), and all hosting and related services we provide (the "Services"). By accessing the website or by purchasing or using any Service, you agree to be bound by this Agreement and our Privacy Policy and Acceptable Use Policy, each of which is incorporated by reference.

Article I. Website

1. Accessing the Website and Account Security

Alterascape may withdraw, amend, or modify the website, any content, or any Services at any time in its sole discretion, without notice. We may restrict access to portions of the website or the entire website, including to registered users, at our discretion. You are solely responsible for making all arrangements necessary to access the website and for ensuring that all persons who access it through your connection are aware of and comply with this Agreement.

All information you provide when registering must be accurate, current, and complete. If you are issued or select a username, password, or other credential, you must treat such information as confidential and not disclose it to any third party. You agree to notify us immediately of any unauthorized access to or use of your credentials or any other security breach. Alterascape staff will never ask for your account password. We reserve the right to disable any username, password, or identifier at any time, in our sole discretion, if we believe you have violated any provision of this Agreement.

2. Intellectual Property Rights

The website and all its contents — including text, software, databases, images, video, audio, and the design, selection, and arrangement thereof — are owned by Alterascape, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. This Agreement permits you to use the website for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any materials from the website without our prior written consent.

Our name, logos, product and service names, designs, and slogans are trademarks of Alterascape or its affiliates. All other trademarks appearing on the website are the property of their respective owners.

3. Prohibited Uses

You agree not to use the website or Services for any unlawful or prohibited purpose, including:

• Using the website in violation of any federal, state, local, or international law or regulation
• Exploiting or harming minors, including exposing them to harmful content
• Transmitting unauthorized advertising, junk mail, spam, chain letters, or solicitations
• Impersonating Alterascape, an Alterascape employee, another user, or any other person or entity
• Using automated tools such as robots, spiders, or scrapers without written consent
• Introducing viruses, worms, Trojan horses, or other malicious code
• Attempting unauthorized access to any part of the website, servers, or networks
• Launching denial-of-service or distributed denial-of-service attacks

Any violation may result in immediate suspension or termination of your access to the Services at our sole discretion.

Article II. Services

4. Scope of Services

Subject to your compliance with this Agreement and timely payment of all fees, Alterascape agrees to provide the Services you select in your order. Services include, but are not limited to, Shared Hosting, WordPress Hosting, Drupal Hosting, Virtual Private Servers (VPS), Dedicated Servers, domain registration, SSL certificates, and related add-on services. We reserve the right to withdraw, suspend, or amend any Service at any time to maintain the stability, security, or integrity of our network, or to comply with law.

Domain registration services are provided subject to applicable registry policies and ICANN Registrant Rights and Responsibilities. Domain registrations are non-refundable once completed. Alterascape is not responsible for errors in WHOIS data resulting from information you provide.

5. Account Setup and Activation

Services may be provisioned immediately following payment and fraud screening, but certain services — including Dedicated Servers and complex configurations — may require manual intervention. Typical provisioning windows are estimates only and are not binding commitments. Migration times vary depending on the previous host and application complexity. Alterascape will use best-faith efforts to meet expected timelines but does not guarantee specific delivery dates.

6. Resource Usage

To preserve system stability, Shared and WordPress Hosting accounts are subject to reasonable resource allocations. Each account is limited to one (1) CPU core, one gigabyte (1 GB) of RAM, fifty (50) concurrent processes, ten megabytes per second (10 MB/s) of disk I/O, three hundred thousand (300,000) inodes, and two gigabytes (2 GB) of total database usage. Higher-tier accounts may include additional resources.

VPS and Dedicated Servers are restricted to the resources purchased with your plan, though upgrades are available. Excessive or abusive consumption of resources may result in notification, temporary restriction, or required upgrade at our discretion. You agree not to use the Services primarily as a file storage or download repository. Non-web file storage (including games, videos, music files, or backups) may not exceed ten percent (10%) of your account's space or bandwidth, unless otherwise authorized in writing.

7. Bandwidth Usage

Monthly bandwidth allocations are defined by your plan. As you approach your limit, we will send a notice to the contact email on file. If exceeded, you may upgrade your plan, purchase additional bandwidth at the rate of $0.50 per gigabyte (GB), or wait until the next billing cycle resets your allocation. Failure to address overages may result in temporary suspension until resolved.

8. Email Policy and Spam

You agree not to use the Services to send unsolicited bulk messages, spam, or material that violates applicable law. Shared and WordPress Hosting accounts may send no more than three hundred (300) email messages per hour per account, unless a higher limit is expressly authorized in writing. VPS and Dedicated Servers are not subject to fixed caps but may not be used solely as bulk email platforms. We reserve the right to suspend or terminate accounts engaged in spamming or abusive email practices. Administrative cleanup fees may be charged where your account causes deliverability or reputational damage to Alterascape's mail infrastructure.

9. Data Backups

Alterascape maintains rolling backups as a convenience but does not guarantee availability, completeness, or integrity of any backup. Backup retention is generally:

• Shared & WordPress Hosting: 30 days
• Drupal Hosting: 30 days
• VPS Hosting: 2 days (snapshots available separately)
• Dedicated Servers: Backups are not included by default. Retention period and frequency are determined by the backup add-on purchased at the time of order. No backup service is provided unless explicitly added to your plan.

You are solely responsible for maintaining independent backups of your data. Alterascape disclaims all liability for data loss, corruption, or inability to restore backups.

10. Data After Termination

Upon termination of Services, all customer data may be deleted immediately or within a short operational period. We may retain archival copies for legal, compliance, or disaster-recovery purposes for a reasonable time, but we are under no obligation to return or preserve customer data after termination. You are solely responsible for exporting or backing up your data prior to termination.

11. Term and Termination

This Agreement commences on the Service Commencement Date and continues for the Initial Term specified in your order. It automatically renews for successive Renewal Terms of equal length unless either party provides timely notice of non-renewal. To stop auto-billing for Shared Hosting, WordPress Hosting, Drupal Hosting, VPS, and Dedicated Servers, written notice is required at least seven (7) days prior to the payment due date.

Alterascape may suspend or terminate Services immediately, with or without notice, if: (i) you breach this Agreement or the AUP; (ii) you fail to pay fees when due; (iii) we reasonably believe suspension is necessary to protect our network or other customers; or (iv) requested by law enforcement. Upon termination, you must cease using the Services and remove all Alterascape software.

12. Cancellations, Refunds, and Money-Back Guarantee

Alterascape offers a thirty (30) day money-back guarantee for first-time Shared Hosting, WordPress Hosting, and Drupal Hosting customers. Refunds apply only to base hosting fees and exclude setup, administrative, or domain registration fees. Refund requests must be made within thirty (30) days of the Service Commencement Date.

VPS, Dedicated Servers, and all Professional Services are non-refundable, and no money-back guarantee applies. All sales for these services are final, except as required by law. No pro-rated refunds are issued after the initial thirty (30) day period. Refunds are processed to the original payment method within thirty (30) business days after approval. Existing, returning, or additional-account customers are not eligible for money-back guarantees.

Article III. General Provisions

13. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Alterascape disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Without limiting the foregoing, Alterascape makes no representation or warranty that: (a) the Services will be uninterrupted, error-free, or completely secure; (b) defects will be corrected; (c) the servers or network will be free of viruses or other harmful components; or (d) the Services will otherwise meet your needs or expectations.

14. Limitation of Liability

To the fullest extent permitted by law, Alterascape's maximum aggregate liability to you for any and all claims, whether in contract, tort, or otherwise, shall not exceed an amount equal to the fees you paid for three (3) months of Services immediately preceding the event giving rise to the claim.

In no event shall Alterascape, its affiliates, employees, officers, directors, agents, contractors, licensors, or suppliers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation lost profits, lost revenue, loss of goodwill, business interruption, or data loss, even if advised of the possibility of such damages. These limitations apply regardless of the cause of action.

Any claim arising out of or related to this Agreement must be filed within one (1) year after the cause of action accrues, or such claim shall be permanently barred.

15. Indemnification

You agree to defend, indemnify, and hold harmless Alterascape and its officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your actual or alleged use of the Services in violation of law or this Agreement
• Any material or data submitted, stored, or transmitted by you that infringes third-party intellectual property or other rights
• Any products, services, or content sold or distributed by you using the Services
• Any willful misconduct, fraud, or negligence by you or your agents

16. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, exclusive of its conflict of laws principles, and the laws of the United States of America where applicable. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. Any action arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Orange County, Florida. You consent to personal jurisdiction in such courts.

Alterascape reserves the right to amend or update this Agreement at any time in its sole discretion. Updates will be effective upon posting on the website or other reasonable notice to you. Continued use of the Services following notice constitutes acceptance of the updated terms.
